Terms of Service

These Terms of Service ("Terms") govern your use of StayShot (https://stayshot.net), an AI photo enhancement service operated by Victoria Dorofeieva ("we," "us," "our"). By creating an account or using StayShot, you agree to these Terms.

1. The Service

StayShot is an AI-powered photo enhancement tool designed for short-term rental hosts. You upload photos of your rental property, and our AI enhances them to look like professional listing photos.

What StayShot does:

  • Removes clutter and personal items from photos
  • Improves lighting and composition
  • Adds light staging touches (small decorative elements)
  • Straightens tilted lines and adjusts framing

What StayShot does NOT do:

  • Guarantee that enhanced photos will be identical to any specific reference
  • Promise that every enhancement will be perfect — AI results may vary
  • Create photos from scratch — we enhance your existing photos
  • Provide interior design, photography, or real estate services

2. Your Account

To use StayShot, you must create an account with a valid email address. You are responsible for:

  • Providing accurate account information
  • Keeping your password secure
  • All activity that occurs under your account
  • Notifying us immediately if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that:

  • Use fake or disposable email addresses
  • Create multiple accounts to abuse the free tier
  • Violate these Terms
  • Engage in abusive, fraudulent, or illegal activity

3. Plans and Pricing

Free Plan

  • 3 photo enhancements (lifetime total, not per month)
  • No credit card required

Starter Plan — €19/month

  • 30 photo enhancements per month
  • Quota resets monthly on your subscription anniversary

Pro Plan — €49/month

  • 100 photo enhancements per month
  • Quota resets monthly on your subscription anniversary

Pricing changes: We may change our prices at any time. Price changes take effect at the start of your next billing cycle. We will notify you by email at least 30 days before any price increase. If you do not agree with the new price, you may cancel your subscription before the change takes effect.

Unused photos do not roll over. If you use 20 of your 30 Starter photos in a month, the remaining 10 do not carry forward to the next month.

4. Payments and Billing

  • All payments are processed securely by Stripe.
  • Subscriptions are billed monthly in EUR (€) on the anniversary of your signup date.
  • Prices are inclusive of applicable taxes (VAT, sales tax). Stripe handles tax calculation and remittance.
  • You can cancel your subscription at any time through the customer portal in your account settings. Cancellation takes effect at the end of your current billing period — you keep access until then.
  • No refunds for partial months. If you cancel mid-cycle, you retain access to the service until the end of your paid period but will not receive a prorated refund.
  • If a payment fails, we will notify you and retry. If payment continues to fail, your account will be downgraded to the Free plan after 7 days.

5. Your Content (Photos)

Ownership

You retain full ownership of all photos you upload to StayShot. We do not claim any ownership rights over your original or enhanced photos.

License you grant us

By uploading photos, you grant us a limited, non-exclusive license to:

  • Process your photos through our AI enhancement system
  • Store your photos on our servers for the purpose of providing the service
  • Send your photos to our AI processing provider (OpenAI) for enhancement

This license exists solely for the purpose of providing you with the StayShot service. We will not use your photos for marketing, training, selling, or any other purpose without your explicit written consent.

Your responsibilities

You represent and warrant that:

  • You own the photos you upload, or have the right to use them
  • Your photos do not infringe on any third party's intellectual property rights
  • Your photos do not contain illegal, harmful, or inappropriate content
  • You will not upload photos of people without their consent

Photo accuracy and listing compliance

Important: StayShot enhances photos using AI, which may add small decorative elements (plants, candles, throws) or adjust lighting and composition. The enhanced photos may not be an exact representation of your property as-is.

You are responsible for ensuring that your listing photos comply with the terms of service of the platforms where you post them (Airbnb, Vrbo, Booking.com, etc.). Some platforms have policies about photo accuracy. We recommend reviewing those policies before using enhanced photos on your listings.

StayShot is not liable for any consequences arising from the use of enhanced photos on third-party platforms, including but not limited to listing removal, guest complaints, or policy violations.

6. Acceptable Use

You agree NOT to:

  • Use StayShot for any illegal purpose
  • Upload photos containing illegal content, violence, nudity, or harmful material
  • Attempt to reverse-engineer, decompile, or extract our AI prompts, algorithms, or systems
  • Use automated tools (bots, scrapers) to interact with StayShot
  • Create multiple accounts to circumvent usage limits or abuse the free tier
  • Resell, sublicense, or redistribute the StayShot service without our written permission
  • Interfere with or disrupt the service, servers, or networks connected to StayShot
  • Attempt to gain unauthorized access to any part of the service

7. Intellectual Property

Our IP

StayShot, including its name, logo, website design, AI prompts, enhancement algorithms, and all related software, is our intellectual property. You may not copy, modify, or distribute any part of StayShot without our written permission.

Your IP

You retain all rights to your photos. We claim no ownership over any content you upload or the enhanced versions we produce for you.

8. Service Availability

  • We strive to keep StayShot available 24/7, but we do not guarantee uninterrupted service.
  • We may perform maintenance, updates, or improvements that temporarily affect availability.
  • Our AI enhancement depends on third-party services (OpenAI, Supabase, Stripe). Outages or changes in those services may affect StayShot's functionality.
  • We will make reasonable efforts to notify you of planned downtime in advance.

9. Limitation of Liability

To the maximum extent permitted by law:

  • StayShot is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that AI enhancements will meet your specific expectations or requirements.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of StayShot.
  • Our total liability to you for any claims arising from these Terms or your use of StayShot is limited to the amount you have paid us in the 12 months preceding the claim.
  • We are not liable for any loss of bookings, revenue, or business opportunities resulting from the use or inability to use StayShot.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded by applicable law

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your use of the service
  • Your photos or content
  • Your violation of any third party's rights

11. Termination

By you

You can delete your account at any time. Upon deletion:

  • Your subscription (if any) will be cancelled
  • Your photos will be permanently deleted within 30 days
  • Your personal data will be handled according to our Privacy Policy

By us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in abusive or fraudulent behavior
  • Fail to pay subscription fees after notice
  • Have not used your account for 12 consecutive months (we will notify you first)

12. Dispute Resolution

Governing law

These Terms are governed by the laws of Italy.

Dispute resolution

If you have a dispute with us, we encourage you to contact us first at support@stayshot.net so we can try to resolve it informally. If we cannot resolve the dispute informally within 30 days, either party may pursue legal action in the courts of Lecce, Italy.

EU Online Dispute Resolution

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the "Last updated" date at the top
  • We will notify you by email at least 30 days before material changes take effect
  • Your continued use of StayShot after changes take effect constitutes acceptance of the new Terms

If you do not agree with the updated Terms, you may cancel your account before the changes take effect.

14. General

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and StayShot.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
